We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuance of the Service.

3. Eligibility and Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You must be at least 18 years of age to create an account. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

You are solely responsible for the activity that occurs on your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to terminate or suspend accounts that violate these Terms or for any other reason at our sole discretion.

4. Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your email address and password. You agree not to share your credentials with any third party.

You agree to accept responsibility for all activities that occur under your account. If you believe your account has been compromised, you must change your password immediately and contact us through the chat button on our platform. We are not liable for any loss or damage arising from unauthorized use of your credentials.

5. Trading Disclaimer and Risk Acknowledgment

TheProfitPath is a journaling and analytics tool only. We are not a registered investment advisor, financial advisor, broker, or dealer. Nothing on this platform constitutes financial, investment, or trading advice.

All trading involves risk, including the risk of loss of capital. You acknowledge that:

• You are solely responsible for your trading decisions
• You have not relied on TheProfitPath for any investment advice
• You understand that trading futures, forex, stocks, options, and other financial instruments carries significant risk
• Past performance metrics and statistics do not guarantee future results
• You should consult with a qualified financial advisor before making any investment decisions

We strongly recommend that you only trade with capital you can afford to lose. Never risk more than you can afford to lose in any single trade or time period.

6. Subscriptions and Billing

TheProfitPath offers both free and premium subscription tiers. Premium subscriptions provide access to advanced features and are billed on a monthly or annual basis depending on the plan you select.

Free Tier: TheProfitPath offers a free tier with basic features. Premium subscriptions provide access to advanced features and are billed on a monthly or annual basis depending on the plan you select.

Billing: Subscription fees are billed in advance at the start of each billing period. All fees are non-refundable except as required by law. We reserve the right to change subscription pricing at any time, with changes taking effect at the next billing cycle after notice.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. You will retain access to premium features until the end of your paid period.

Upgrades: You may upgrade your subscription at any time. Upgrades take effect immediately, and you will be charged a prorated amount for the remainder of your current billing period.

7. Acceptable Use Policy

You agree not to use the Service for any purpose that is illegal, prohibited by these Terms, or in any way that could damage, disable, overburden, or impair the Service.

You specifically agree not to:

• Use the Service for any illegal purpose or in violation of applicable laws

You retain ownership of all trading data, journal entries, notes, and content you input into TheProfitPath ("User Content"). By inputting data into the Service, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the Service to you.

We implement appropriate technical and organizational measures to protect your User Content against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

You are responsible for maintaining backups of your trading data. We recommend regularly exporting your data from the Service. We are not responsible for any loss of User Content, except as required by applicable law.

We collect and process personal information in accordance with our Privacy Policy. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

You acknowledge that connecting your brokerage accounts to TheProfitPath is voluntary and that any data shared with connected brokerages is governed by the brokerage's own terms and privacy policy.

11. Intellectual Property Rights

The Service and its original content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software) are owned by TheProfitPath and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. You may not reverse engineer, decompile, or disassemble the Service, except as permitted by applicable law.

TheProfitPath name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of TheProfitPath. You may not use such marks without our prior written permission.

12. Copyright and DMCA

We respect the intellectual property rights of others and expect users of the Service to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us.

If you believe your copyrighted work has been copied in a way that constitutes copyright infringement, please provide us with the following information:

• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing

In no event shall our total liability arising out of or related to these Terms or the Service exceed the amount of fees paid by you to us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

The limitations of liability in this section apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

• Any trading results reported through the Service will be achieved

15. Indemnification

You agree to defend, indemnify, and hold harmless TheProfitPath and its operators, affiliates, officers, directors, employees, agents, and partners from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of any third-party right, including intellectual property or privacy rights

• Your trading activities and decisions

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.

• We may delete your account and User Content at our discretion
• We are not obligated to provide you with access to your User Content after termination
• Any fees paid are non-refundable except as required by law

18. Account Data Export and Deletion

You have the right to export all your User Content from the Service at any time through your account settings or by contacting us. We will provide your data in a commonly used, machine-readable format.

You may request deletion of your account and associated User Content by using the chat button on our platform. We will process deletion requests within 30 days, subject to any legal retention requirements.

Following account deletion, your data will be removed from our active systems within 30 days. Residual copies may remain in our backup systems for up to 90 days.

19. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue other legal remedies available under applicable law.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

20. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and TheProfitPath regarding your use of the Service and supersede all prior agreements and understandings.

Waiver: Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Assignment: You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. We may assign these Terms at any time without notice to you.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
